Terms of Service

These Terms of Service ("Terms") are a legal agreement between you ("you", "Customer") and GrowVPS ("GrowVPS", "we", "us") governing your access to and use of the GrowVPS service. By creating an account, paying for a subscription, or using the service, you agree to these Terms. If you are entering into these Terms on behalf of a company or other organization, you represent that you have authority to bind that entity.

Plain-English summary (not a substitute for the full text below): You pay a flat monthly fee for a dedicated server we build and manage for you. Your data is yours — you can export it in full at any time, and we take a snapshot before we ever destroy anything. We provide the service "as is" and our liability is capped. Read the details before you rely on them.

1. The service

GrowVPS provisions and operates a dedicated virtual private server for each customer, pre-installed with our growth software stack ("Growth OS"), a database and cache layer, automatic TLS, and daily encrypted backups. The server is provisioned to your own subdomain and is intended to run your growth, marketing, and business workloads. We manage the underlying provisioning, updates, backups, and monitoring; you control the data and business configuration you place on the box.

We may add, change, or remove features over time. Some capabilities depend on third-party providers (see Section 8) and may change if those providers change.

2. Accounts & eligibility

You must be at least 18 years old and able to form a binding contract to use GrowVPS. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your account and sign-in credentials, and for all activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorized access.

3. Subscription & billing

GrowVPS is a paid subscription service. The current standard plan is $499 per month (USD), billed in advance, unless a different price is presented to you at checkout. Prices exclude taxes; you are responsible for any applicable sales, use, VAT, or similar taxes.

Payments are processed by our payment provider, PayPal. When you subscribe, you authorize us (through PayPal) to charge your payment method the recurring subscription fee plus any applicable taxes. We do not store or have access to your full card number; card data is handled entirely by PayPal. If a charge fails, we may retry it and may suspend or limit the service until payment succeeds (see Section 13).

Except where required by law or expressly stated in these Terms, fees are non-refundable and there are no refunds or credits for partial subscription periods, unused time, or downgrades.

4. Auto-renewal & price changes

Your subscription renews automatically each month on your billing date and your payment method is charged for the next period until you cancel. You may cancel at any time (see Section 5); cancellation stops future renewals. We may change subscription prices or plan structures on a prospective basis; we will give you reasonable advance notice (for example, by email) before a price change takes effect, and the new price applies to renewals occurring after the notice period. Continuing to use the service after a price change takes effect constitutes acceptance of the new price.

5. Cancellation & teardown

You can cancel your subscription at any time by using the cancellation flow or by contacting [email protected]. When you cancel:

  • Auto-renewal is turned off and you will not be charged for the next billing period.
  • Your box generally remains available through the end of the paid period you have already been billed for, unless you request immediate teardown.
  • We take a final snapshot and complete a data export before any destructive action. Teardown of your server is gated: it does not proceed until your export has completed, and a snapshot is taken before the box is destroyed. This is part of our "Built, Not Rented" commitment (see Section 6).
  • After teardown, backups and snapshots are retained only for the limited window described in our Privacy Policy, then deleted.

If your subscription ends for non-payment, the same export-and-snapshot-before-destroy sequence applies before your server is decommissioned, subject to the retention windows in the Privacy Policy.

6. Your data, ownership & export

As between you and GrowVPS, you own all data, content, and business configuration you create or store on your box ("Customer Data"). We claim no ownership of Customer Data. You grant us only the limited rights necessary to host, back up, secure, transmit, and operate the service on your behalf.

Built, Not Rented. We commit to no lock-in: you may request a full export of your Customer Data at any time during your subscription and as part of cancellation. We take snapshots before destroying anything, and we design the stack so that what you build is portable and belongs to you. You are responsible for keeping your own copies of any exports you download.

7. Acceptable use

You agree not to use GrowVPS, and not to allow anyone to use your box, to:

  • violate any applicable law or regulation, or infringe anyone's intellectual property, privacy, or other rights;
  • send unlawful, unsolicited bulk, or deceptive communications ("spam"), or violate anti-spam, telemarketing, or electronic-messaging laws, or the terms of any connected third-party platform;
  • store or transmit malware, or attempt to gain unauthorized access to any system, account, network, or data;
  • engage in cryptocurrency mining, denial-of-service activity, or other resource abuse that degrades shared infrastructure;
  • host or distribute content that is unlawful, that sexually exploits minors, or that harasses, defames, or threatens others;
  • resell, sublicense, or provide the service to third parties in a way not permitted by these Terms; or
  • circumvent usage limits, security controls, or billing.

You are responsible for your use of any connected third-party accounts (including social-media accounts you authorize) and for complying with those platforms' terms. We may investigate suspected violations and may suspend or terminate service for violations (see Section 13).

8. Third-party services

GrowVPS relies on third-party infrastructure and service providers (sub-processors) to operate — including our payment processor, hosting/compute provider, DNS and network provider, transactional email provider, and our social-publishing provider. These providers are described in our Privacy Policy. Your use of the service may be subject to those providers' availability and terms, and we are not responsible for the acts or omissions of third parties beyond our reasonable control.

9. Availability & support

We work to keep the service available and to provide reasonable support, but we do not guarantee uninterrupted or error-free operation. The service may be unavailable during maintenance, updates, or events outside our control. Unless a separate written service-level agreement (SLA) applies to your account, the service is provided without any uptime guarantee. Support is provided by email at [email protected].

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DATA WILL NOT BE LOST OR CORRUPTED. YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN BACKUPS OF EXPORTED DATA. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GROWVPS AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE LIABILITY. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless GrowVPS from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to your Customer Data, your use of the service, your violation of these Terms, or your violation of any law or the rights of a third party.

13. Suspension & termination by us

We may suspend or terminate your access to the service if you materially breach these Terms (including the acceptable-use policy), if your payment fails and remains unresolved, or if we reasonably believe suspension is necessary to protect the service, other customers, or third parties. Where practical, we will give notice and an opportunity to cure. On termination, the export-and-snapshot-before-destroy process in Sections 5 and 6 applies, subject to the retention windows in the Privacy Policy.

14. Changes to the service or Terms

We may modify these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you (for example, by email or an in-product notice). Changes are effective when posted unless stated otherwise. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.

15. Governing law

These Terms are governed by the laws of [Your State], without regard to its conflict-of-laws rules. You and GrowVPS agree to the exclusive jurisdiction of the state and federal courts located in [Your State] for any dispute not subject to arbitration or small-claims resolution, except that either party may seek injunctive relief in any court of competent jurisdiction.
